Virginia State and Local Government

Virginia law states that there will be no primary in races "when less than two candidates declare" [Code of Virginia §24.2-526].

The Democratic and Republican parties may choose to nominate by convention or primary election. The deadline to notify the State Board of Elections of the adoption of the primary election is TBD. Nominees must be selected by TBD.

24 February 2026: Primary elections moved to 4 August 2026. from the Virginia Department of Elections. The 2026 Primary Election date was changed by the General Assembly in House Bill 29, which was signed into law on 20 February. Under this new law, the primary date change is only for the 2026 election year.

21 April 2026: The Virginia proposed constitutional amendment passed with 51.23% of the vote. Hence, Virginia will change its U.S. House district boundaries for 2026 to favor the Democrats in 4 seats.
22 April 2026: Virginia Circuit Court Judge Jack Hurley ruled the referendum unconstitutional. Virginia Attorney General Jay Jones (Democratic) stated he will appeal the ruling.
26 April 2026: Richmond Circuit Court Judge Tracy Thorne-Begland allows the new voter approved U.S. House district boundaries to proceed [Republican National Committee v. Virginia State Board of Elections, CL26-1208].
27 April 2026: The Virginia Supreme Court hears oral arguments regarding the process used by the state Legislature to creating the redistricting ballot measure [Scott v McDougle, 260127].

8 May 2026: The Virginia Supreme Court nullifies voter approved Congressional redistricting. "We hold that the legislative process employed to advance this proposal violated Article XII, Section 1 of the Constitution of Virginia. This constitutional violation incurably taints the resulting referendum vote and nullifies its legal efficacy." [Scott v McDougle, 260127]. This decision appears to discard Virginia's new congressional map 10-1 (favoring the Democrats) and restores the old 6-5 map.

11 May 2026: The Virginia Democrats asked the U.S. Supreme Court to restore their 10-1 congressional district map [Scott v McDougle, 25A1240 ].
15 May 2026: The U.S. Supreme Court refused to act.
