New York State permits so-called "cross-endorsements", in which a candidate is allowed to appear on more than one Party's ballot line: thus, a candidate who loses the nomination of one of the two Major Parties for a given office but has already been nominated for that same office by at least one Party which is not one of the two Major Parties will still appear somewhere on the General Election ballot despite losing said Primary; in other words, a candidate losing in the Primary does not necessarily preclude that candidate from running for the same office in November. Primaries are not used when a Special Elections is called to fill a vacant U.S. House Seat. Parties nominate their candidates and independents submit petitions to appear on the Special Election ballot. The Congressman stated "I can't subject my family and staff to a full investigation ... It would tear us apart" regarding his alleged sexual harassment of a male staffer. 8 March 2010: Congressman Massa, who was first elected in 2008, resigned-- "effective at 5 PM on Monday the 8th of March I will resign my position as the Federal Representative of New York's 29th Congressional District in the 111th Congress. I do so with a profound sense of failure and a deep apology to all those whom, for the past year, I tried to represent as our Nation struggles with problems far greater than anyone can possibly imagine." 1 April 2010: Governor David Paterson (Democratic) decides not to call a special election to fill the vacancy.
