New York State and Local Government


New York State permits so-called "cross-endorsements", in which a candidate is allowed to appear on more than one Party's ballot line: thus, a candidate who loses the nomination of one of the two Major Parties for a given office but has already been nominated for that same office by at least one Party which is not one of the two Major Parties will still appear somewhere on the General Election ballot despite losing said Primary; in other words, a candidate losing in the Primary does not necessarily preclude that candidate from running for the same office in November.

Primaries are not used when a Special Elections is called to fill a vacant U.S. House Seat. Parties nominate their candidates and independents submit petitions to appear on the Special Election ballot.

Appointed by Governor Paterson to fill vacancy caused by his own accession to the Governor's Chair, 8 July 2009 (an appointment that was challenged in State court); on 9 July 2009, a New York Supreme Court (the State's trial bench) order permitted Ravitch to take the Oath of Office and thereafter function as Lieutenant Governor (except insofar as presiding over the State Senate was concerned) pending resolution of the legal dispute over his appointment; on 22 September 2009, the Court of Appeals (NEW YORK's highest court) ruled that Ravitch's appointment was constitutional and, therefore, he could thereafter exercise all powers and duties of Lieutenant Governor (including constitutional succession to the Governorship, if necessary).

3 March 2010: Congressman Eric J. J. Massa (Republican) announced he has Non-Hodgkin Lymphoma and will not seek re-election.
5 March 2010: Congressman Massa indicated that he will resign on Monday 8 March 2010 5p EST. The Congressman stated "I can't subject my family and staff to a full investigation ... It would tear us apart" regarding his alleged sexual harassment of a male staffer.
8 March 2010: Congressman Massa, who was first elected in 2008, resigned-- "effective at 5 PM on Monday the 8th of March I will resign my position as the Federal Representative of New York's 29th Congressional District in the 111th Congress. I do so with a profound sense of failure and a deep apology to all those whom, for the past year, I tried to represent as our Nation struggles with problems far greater than anyone can possibly imagine."
1 April 2010: Governor David Paterson (Democratic) decides not to call a special election to fill the vacancy. "We have some serious concerns about the financial impact that a special election could have...."
12 May 2010: Reports state that New York Governor David Paterson will schedule a special election to replace Democratic Congressman Eric Massa on 2 November 2010.
25 May 2010: U.S. District Court Judge David Larimer heard arguments on whether or not the Constitution requires the state to call a special election.
  • When vacancies happen in the Representation from any State, the Executive Authority thereof shall issue Writs of Election to fill such Vacancies. [U.S. Constitution: Article I, Section 2, clause 4]
23 September 2010: A special 2 November 2010 election was called to fill the unexpired term (November and December 2010) of Congressman Eric J. J. Massa who resigned on 8 March 2010.
2 November 2010: Corning New York Mayor Thomas W. "Tom" Reed, II (Republican; Conservative; Independence) won the special election with 57% of the vote.
