NOTE [This note was first posted at 2:10 PM EST (1910 GMT), Tuesday 31 January 2012, before any returns from the FLORIDA Republican Presidential Primary could have been known]: There has been more than a little "buzz", of late, about the possibility of a protest by losing candidates in this Primary- most notably, the presidential contender who ends up in second place- against the National Convention delegates from FLORIDA being awarded on a 'Winner Take All' basis to the statewide winner of this Primary.

It should be fairly noted that any such protest after the voting in a Presidential Primary has already taken place would have to be taken up with the Republican National Committee, the Rules Committee (or equivalent) of the 2012 Republican National Convention and (ultimately, should such a protest even make it that far) a Roll Call vote on the floor of that Republican National Convention itself this coming late summer.

Assuming- if only for sake of this note- that such a protest emerges in the first place, it is probably going to very closely resemble what happened 40 years ago re: the *Democratic* National Convention, where Senator/former Vice President Hubert Humphrey protested- and, thereby, attempted to challenge- the rule allowing for all National Convention delegates from California to be awarded to Senator George McGovern [the eventual presidential nominee] as the result of a Winner Take All Presidential Primary in *that* State in 1972. A Federal court challenge ensued- culminating (on the very eve of the Convention) in a case argued before the United States Supreme Court (this being Brown v. O'Brien [409 U.S. 1 (1972)]), in which the Supreme Court decided *not* to decide the issue, leaving the resolution of this dispute to the 1972 Democratic National Convention itself.

All in all, any such protest as regards the binding of delegates to the statewide winner of today's FLORIDA Republican Presidential Primary is likely to have more than a few elements similar enough to what happened on the *Democratic* side of things four decades ago now. To this end, those interested might want to take a look at a more detailed summary of those long-ago events included as a large part of a Commentary [dated 19 March 2008] by Richard E. No later than 1 October 2011, the Florida Presidential Preference Primary Date Selection Committee will set the date of the Florida Presidential Primary. On 30 September 2011, the Florida Presidential Preference Primary Committee voted 7-2 to hold the Florida Presidential Primary on Tuesday 31 January 2012.

The information below was updated on 28 December 2011 to reflect a 50% penalty. "In the event that the Republican National Convention refuses to seat the full allotment of ... Florida delegates ... shall be Delegates at Large..." [Republican Party of Florida Rule 10 M.].

The information below was updated on 17 January 2012 to reflect a 50% penalty. "In the event that the Republican National Convention refuses to seat the full allotment of Florida delegates, all remaining delegates shall be Delegates at Large and shall be selected by the Chairman of the Republican Party of Florida from the original delegation. In that event, the Chairman shall select at least 1 delegate from each congressional district, with the advice and consent of each State Executive Committee Congressional District Chairman." Tuesday 31 January 2012: All 99 50 of Florida's delegates to the Republican National Convention are allocated in today's Florida Presidential Primary. [Republican Party of Florida Rule 10 B. and D]

  • The candidate receiving the greatest number of votes in any congressional district shall receive all that Districts National Convention Delegates. Two thirds of the National Convention Delegates are elected from the Congressional Districts. Each Congressional District receives the same number of delegates. When computing the two thirds, round factions down to the whole number. The remaining delegates are at-large.
    • Before penalty: 96 delegates × 2/3 = 64 delegates. 64 delegates ÷ 27 Congressional Districts = 2.37 delegates/district = 2 delegates/district for a total of 54 District delegates. Pre-penalty: 96 delegates - 54 District delegates = 42 At-Large delegates.
  • The candidate receiving the greatest number of statewide votes shall receive all of the At-Large Delegates. (Since Florida has been sanctioned, all delegates will be elected at-large.)

Within one week after the Presidential Preference Primary, each Republican presidential candidate whose name appeared on the Presidential Preference Primary ballot shall submit to the Chairman of the Republican Party of Florida a list of proposed delegates ... who shall be considered as candidates ... to be elected as delegates.... The names and addresses of the proposed candidate’s supporters shall be distributed ... to the various ... electing bodies prior to the holding of any elections for the purpose of electing delegates .... [Republican Party of Florida Rule 10 C.]

3 party leaders, the National Committeeman, the National Committeewoman, and the chairman of the Florida's Republican Party, will attend the convention, by virtue of their position, bound to the presidential contender receiving the greatest number of votes in the primary statewide as guests.

National Convention Delegates are bound through the 3rd ballot unless the candidate withdraws or releases his/her delegates. "The Chairman ... shall be bound to ... cast all Delegate at Large votes ... during the first three convention ballots .... If the candidate... releases the delegates or withdraws his or her candidacy, then said delegate votes will not be bound to any candidate. [Republican Party of Florida Rule 10 B.]


Mitt Romney, having received the most votes in the Tuesday 31 January 2012 primary, wins all 50 delegates.

 

Tuesday 7 February - Friday 30 March 2012: Congressional District Caucuses meet to elect the National Convention District delegates according to the results of the primary. Each Congressional District elects 2 delegates using the 2000 Census districts-- 2 delegates × 25 CDs = 50 delegates.

 

Friday 27 April - Saturday 28 April 2012: Quarterly Meeting. The At-Large delegates are selected according to the results of the primary. The party is selecting a full delegation of 99 and 96 alternates in compliance with RPOF rules. There are no alternates for RPOF Chairman, RPOF’s National Committeeman, or RPOF National Committeewoman.


Notes:

On 8 February 2011 State Senator Arthenia Joyner (Democratic) filed S 860. On 9 February state Representative Martin David "Marty"Kiar (Democratic) filed companion HB 695. These bills move the state's Presidential primary from from the last Tuesday in January (24 January 2012) to the first Tuesday in March (6 March 2012). Statue reference: 103.101.

On 19 May 2011, Florida Governor Richard L. "Rick" Scott (Republican) signed HB 1355 which, among other things, creates the Presidential Preference Primary Date Selection Committee. This committee has until 1 October 2011 to set the date of the 2012 Presidential Primary. That date will be no earlier than the 1st Tuesday in January (3 January 2012) and no later than the 1st Tuesday in March (6 March 2012). There are 10 members: The Secretary of State (the non-voting chair), 3 appointed by the Governor (no more than 2 may be from the same political party), 3 appointed by the Speaker of the House of Representatives (no more than 2 may be from the same political party), and 3 appointed by the President of the Senate (no more than 2 may be from the same political party).


On 30 September 2011, the Florida Presidential Preference Primary Date Selection Committee voted 7-2 to hold the Florida Presidential Primary on Tuesday 31 January 2012.

The date appears to put the Florida Republican delegate selection plan in violation of the Rules of the Republican Party. Rule 15(b)(1) states

"No primary, caucus, or convention to elect, select, allocate, or bind delegates to the national convention shall occur prior to the first Tuesday in March in the year in which a national convention is held. Except Iowa, New Hampshire, South Carolina, and Nevada may begin their processes at any time on or after February 1 in the year in which a national convention is held ..."

Rule 16(a) indicates that Florida will forfeit 50% of their National Convention delegates.

"If any state or state Republican Party violates The Rules of the Republican Party relating to the timing ... the number of delegates to the national convention from that state shall be reduced by fifty percent (50%) ... "
