If no candidate for United States Senate, U.S. House of Representatives or Governor receives 35% of the vote in the primary, a secondary election, between the two highest vote getters, shall be held two weeks from the date of the primary election.

30 July 2009: Attorney General Larry Long, who was first elected in 2002 and re-elected in 2006, is appointed to a judicial position in the Second Judicial Circuit by Governor Mike Rounds. Mr. Long will resign on 4 September.

19 August 2009: Governor Mike Rounds appointed former U.S. Attorney for South Dakota Marty Jackley as Attorney General.

4 September 2009: Marty Jackley is sworn as South Dakota's 30th Attorney General.
